TRUSTEE'S NOTICE OF SALE NOTICE is hereby given that on Thursday, February 25, 2016, at 10:00 oclock , A.M. at the Main Street entrance of the Cumberland County Courthouse in Crossville, Tennessee, the undersigned, as Trustee, under a deed of trust executed by DADDYS CREEK INVESTMENT GROUP, INC., (the Debtor), dated March 26, 2013, of record at Book 1409, page 824, et seq., Register's Office, Cumberland County, Tennessee, by reason of default in the payment of the obligation secured by said deed of trust and the performance of the covenants therein contained, and at the express direction of the true and lawful holder and owner of said promissory note secured by said deed of trust, will sell, at public auction, to the highest bidder for cash, or credit upon the indebtedness secured, at the option of the holder of the secured indebtedness if the holder is the successful bidder, the interest conveyed to said Trustee by virtue of said deed of trust, and the property therein described, which property lies in the FOURTH CIVIL DISTRICT of Cumberland County, Tennessee, and is more particularly described as follows: Being Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 32, 33, 34, 45, 46, 47, 48, 49, 54, 55, 56, 57, 70, 71, and 72, as appear on the plat of record at Book 11, pages 175, et seq., Register's Office, Cumberland County, Tennessee. There are INCLUDED in the lots referenced above, but specifically EXCLUDED from this Notice, the following lots (renumbered) under a subsequent plat, which were conveyed to third parties: Lots 7, 30, 31, 39, 45, 46, 50, 79, 80, 82, 83, 92, 94, and 130 as appear on the plat of record at Book 11, page 569, said Register's Office. Being part of the same property acquired by Daddys Creek Investment Group, Inc., by virtue of a deed dated March 26, 2013, from Millard V. Oakley, of record at Book 1408, page 2279, Register's Office, Cumberland County, Tennessee. The street or mailing address of the property is Estate Loop Trail and Daddys Creek Trail, Crossville, Tennessee 38555. The property is identified in the records of the Assessor of Property for Cumberland County, Tennessee on Exhibit "A" attached hereto. Other parties who may have an interest include: Rocco Toscano, Magdiel Rodriguez, Sarah Tombaugh Architecture, PLLC, Daddys Creek Holdings, LLC, Mastiff Group, LLC, DASA Properties, LLC. This sale will be made in bar of the equity and right of redemption without warranty as to title or encumbrances for the purpose of paying the debt obligation secured by said deed of trust. Said sale shall be subject to any restrictions, reservations, conditions and liens of record applicable to said property, and is further subject to any County real property taxes against said property. In the event the high bidder at the foreclosure sale should fail to comply with the submitted bid, the Trustee shall have the option to accept the next highest bid in which the bidder is able to comply or to re-advertise and sell at a later date. Pursuant to Tennessee Code Annotated 35-5-104, as of the date of this Notice, there were no unreleased tax liens filed by the United States of America with respect to which the provisions of 26 U.S.C. 7425(b) require notice to be given to the United States of America in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the United States of America or filed by the State of Tennessee with respect to which the provisions of Tennessee Code Annotated 67-1-1433(b)(1) require notice to be given to the State of Tennessee in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the State of Tennessee, against the Debtors in the Register's Office of Cumberland County, Tennessee.
