COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS January 8, 2016 New York State Homes&Community Renewal New York State Housing Trust Fund Corporation 38-40 State Street Albany, New York 12207 (518) 486-3379 This Notice shall satisfy the above-cited two separate but related procedural notification requirements. REQUEST FOR RELEASE OF FUNDS On or about January 26, 2016, the New York State Homes&Community Renewal, through the New York State Housing Trust Fund Corporation (HTFC), will submit a request to the U. S. Department of Housing and Urban Development (HUD) for the release of Project-Based Vouchers under section 8(o)(13) of the U.S. Housing Act of 1937 (42 U.S.C.1437f(o)(13)), in accordance with section 288 (42 U.S.C. 12838), to undertake a project known as Oneonta Heights, for purposes of Housing Visions Consultants, Inc. proposes new construction of six buildings and the rehabilitation of one building, for families and persons 62 or older, with 60 residential units, on scattered sites in the City of Oneonta, Otsego County. The project is an intergenerational project that will provide 20 units of rental housing for families through the development of (6) buildings with off-street parking and green space, and 40 units of quality rental housing for persons 62 or older in a new construction single building. Public water and sewer are available at the site. Site work will include clearing, grading and excavation, construction of driveways, parking areas and sidewalks, finish grading and landscaping. The proposed project sites are located within desirable locations within the City, access to public transportation, in addition to being in the vicinity commercial services, including proximity to grocery stores, shopping, public transportation and community services. The physical characteristic of each project site will be in line with not only other area affordable housing projects, but also market rate developments within the City and County. FINDING OF NO SIGNIFICANT IMPACT HTFC has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Oneonta City Clerk City Government Office 258 Main Street #1 Oneonta, New York 13820 and may be examined or copied weekdays 8 A.M. to 4 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Heather Spitzberg, either by mail to Environmental Analysis Unit, NYS Housing Trust Fund Corporation, 38-40 State Street, Albany, New York, 12207 or by Email to heather.spitzberg@nyshcr.org. All comments received by January 25, 2016 will be considered by HTFC prior to authorizing submission of a request for release of funds. Those wishing to comment should specify which part of this Notice they are addressing. ENVIRONMENTAL CERTIFICATION HTFC certifies to HUD that Ms. Heather Spitzberg, Esq. in her capacity as Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows HTFC to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and HTFC's certification received by February 10, 2016 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of HTFC; (b) HTFC has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
